1. General Terms
1.1 Radish Ltd, company registration number 556940-2505 ("Radish"), has developed an application to be made available to a user through a computer, mobile phone or tablet, which enables pupils and teachers to interact digitally in mathematics education ("the Application"). The Application is owned and provided by Radish.
1.2 These user terms apply to users of the Application. By user is meant such a person who creates material and content for the Application, as well as uses the Application's functions in their professional work, for example, a teacher ("User").
1.3 The Application is a tool intended to simplify the learning of mathematics for pupils in primary and secondary school. The User can easily and efficiently create and input tasks with mathematical content in the Application. The Application also simplifies the User's administrative tasks regarding the grading of mathematical solutions and enables a more efficient continuous monitoring of pupils' progress.
1.4 Radish hereby grants the User a limited, non-exclusive, and non-transferable right to use the Application in their professional work, provided that the User's authorized superior - board, headteacher or another person or body with the mandate to enter into agreements ("Customer") - has paid the agreed license fee. This right is limited to the number of licenses for which the Customer has paid, in accordance with the current price conditions at any given time. Use of the Service in any other way, such as resale, further licensing, copying, or modification of the Service, is not permitted.
1.5 A prerequisite for the User to utilize the Application and its functions is that an agreement on the right to use the Application has been established between the User's employer and Radish.
1.6 The User creates the content in the Application together with Radish and other users. For the content created and entered into the Application, the User must specifically observe the provisions under section 3.
1.7 By using the Application, the User confirms that they accept the terms of use.
2. Registration, Username, and Password
2.1 The User is obliged to provide true and accurate information about themselves at registration. By completing the registration, the User certifies that the information provided is true and accurate. The User chooses a username and a password at registration. The User must keep this information in a secure manner so that no unauthorized person can access it. Username and password are personal and may not be used by anyone other than the User. Radish reserves the right to, with reasonable notice, request the User to change their password. The User is aware that such a change may cause temporary interruptions in the User's access to the content in the Application. If the User suspects that their username and/or password is being used by someone else, they must immediately change their password. If Radish has reason to believe that the username and/or password has been disclosed to or otherwise misused by an unauthorised person, Radish has the right to immediately close the Application for the User and/or make the services unavailable to the User and/or otherwise prevent continued unauthorised conduct.
2.2 At registration, the User can identify themselves with a school and class to thereby enable the User to connect with the pupils to be educated through the Application.
User-Created Content
3.1 User-created content refers to all such content that a user of the Application creates and/or uploads to the Application, such as images, videos, and descriptive mathematical problems ("User-Created Content").
3.2 The User guarantees that they hold the necessary rights to the User-Created Content, either by creating it themselves (whether it be, for example, an image, a video, or descriptive mathematical problems), or that all who have contributed have given the User permission to use the User-Created Content in the Application.
3.3 The User guarantees that the User-Created Content does not contain copyrighted material, such as protected music, inserted movie sequences, or other copyrighted material that the User has not been given permission to use in the User-Created Content, nor any other trademark or distinctive sign.
3.4 The User guarantees that the User-Created Content does not contain any form of hidden or commercial messages, whether it involves text, image, sound, or video.
3.5 The User guarantees that the User-Created Content cannot be linked to any person. Furthermore, the User guarantees that the User-Created Content does not contain any form of incitement, agitation against a population group, child pornography, or illegal depiction of violence.
3.6 By uploading User-Created Content, the User gives Radish an unrestricted right to freely dispose of the User-Created Content, by, for example, processing, modifying, storing, or copying it and making it available to other users of the Application and to further grant these rights to a third party without the right to compensation thereof.
3.7 Radish's rights according to this user agreement remain even after material or mathematical problems have been deleted by the User or Radish.
3.8 The User hereby waives any claims for compensation from Radish and waives the possible moral rights (copyright) for all use of the User-Created Content.
3.9 Radish reserves the right to remove content created by the User. This applies in particular to content that infringes on third party rights and/or that violates sections 3.2 - 3.5 above.
3.10 Radish cannot be held responsible for content that the User has published in the Application. Radish is not obliged to pre-screen, monitor, edit, or remove content.
3.11 If the User-Created Content violates sections 3.1–3.10, the User may be held responsible according to these user terms and/or according to law.
Availability, Security, and Accuracy of the Application
4.1 Although Radish strives to have the Application available 24 hours a day, Radish cannot be held responsible for any reason the Application is not available at any time. Radish does not guarantee that the User's access to the Application will be uninterrupted, timely, and error-free. Additionally, Radish may occasionally need to carry out maintenance or introduce new features.
4.2 Radish provides the Application as is, without express or implied representations or warranties regarding the Application's functionality, performance, availability, and suitability for a particular purpose. Radish cannot guarantee that the Application will operate flawlessly. Radish is also not responsible for third-party use of the Application in relation to the User.
Personal Data
5.1 The User understands that Radish only processes personal data on behalf of the data controller, i.e., the Customer. For questions regarding the processing of personal data in connection with the application, Radish refers the user to the data controller, i.e., the Customer.
Changes to the User Terms
6.1 Radish has the right to change these user terms. The User is obliged to keep updated on the user terms and to read through the user terms regularly. If the User continues to use the Application after a change has been made to these user terms, the User is considered to have accepted the change.
Consequences of Violation
7.1 In case of violation of the user terms, or if the User otherwise acts in a manner that is not in accordance with what is considered good practice when using the Application, Radish has the right to, temporarily or permanently, suspend the User.
7.2 In interpreting what is customary when using the Application, Radish's opinion shall prevail.
Limitation of Liability: Disclaimer
8.1 Under no circumstances does Radish assume any responsibility for damages incurred by the User or third party, including but not limited to direct or indirect damages or consequential damages, arising from the User's use of the Application.
Disputes
9.1 Swedish law shall apply to these user terms, and disputes shall be resolved in a general court. These terms were adopted on 28 March 2018.
